4. Limitations
In no event shall FontServ or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption,) arising out of the use or inability to use the materials on FontServ’s Internet site, even if FontServ or a FontServ authorised representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

The materials appearing on FontServ’s web site could include technical, typographical, or photographic errors. FontServ does not warrant that any of the materials on its web site are accurate, complete, or current. FontServ has not reviewed all of the sites linked to its Internet web site and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by FontServ of the site. Use of any such linked web site is at the user’s own risk.
7. Personal Account Requirements & Restrictions
If you have a personal site from which no reasonable monthly revenue is generated, you may sign up for our Personal account free of charge. If your site generates a fair amount of monthly revenue, directly or indirectly, you are required to purchase a premium account in order to use this site. FontServ regularly audits Personal Accounts and any Personal Accounts which do not fully adhere to this condition will be sent a request to upgrade to a premium account immediately. Failure to respond to said request will result in the account been deleted without further warning.
8. API Usage Restrictions
The API services provided for the conversion of fonts can only be used when the license of the font been converted specifically allows said font to be “web embedded”. FontServ accepts no responsibility for any misappropriated usage of the API service but should it come to FontServ’s attention that an account is being abused by the account holder by means of executing one or more conversions of copyrighted fonts for which the account holder holds no legal rights to do so, FontServ reserves the right to remove such account immediately without warning or refund. FontServ does not maintain any records or history of the fonts submitted for conversion and all submitted fonts and generated files are deleted from the disk once the conversion process has been completed.
9. Site Terms of Use Modifications
FontServ may revise these terms of use for its web site at any time without notice. By using this web site you are agreeing to be bound by the then current version of these Terms and Conditions of Use.
10. Governing Law
Any claim relating to the FontServ web site shall be governed by the laws of the Republic of South Africa without regard to its conflict of law provisions.
